Please read these terms and conditions carefully. These are the general terms and conditions that govern your business relationship with Aludra Real Estate Brokerage L.L.C and your use of its website (“the Site”).

ACCEPTANCE OF THE TERMS OF USE

This website is owned and operated by Aludra Estates. The following terms and conditions, the lease or sale and purchase agreement (“Property Agreement”)entered into with the Company or any of its affiliates pertaining to a commercial lease, unit or plot in Aludra Estate project in respect of which this website is used together with any documents they expressly incorporate by reference (collectively, these “Terms of Use”), govern your access to and use of www.aludra.ae (the “Website”),including any content, functionality and services offered on or through theWebsite whether as a guest or a registered user.
Please read the Terms of Use carefully before you start to use the Website. By checking out Aludra Estates website or, where applicable, you accept and agreeto the Terms of Use of our website, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, found at www.aludra.ae, incorporated herein by reference.

Aludra Estates names, brand names, the Company’s logos and all related names, logos, product and service names, designs and slogans are trademarks of Aludra Estates or its affiliates or licensors. You must not use such marks without the prior written permission of Aludra Estates. All other names, logos, product and service names, designs and slogans on this Website are the trademarks of their respective owners.

INDEMNIFICATION

You agree to defend, indemnify and hold harmless the Company, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the Website and, any use of the Website’s content, services and products other than as expressly authorized in these Terms of Use or your use of any information obtained from the Website.

WAIVER ANDSEVERABILITY

No waiver of by the Company of any term or condition set forth in these Terms ofUse shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

The user's responsibility towards attempts to defraud him

Electronic communications such as emails, text messages, phone calls, and social media messages are neither secure. While real estate brokerages have adopted policies and procedures to help avoid fraud, the best security protections can still be bypassed by unauthorized parties. Therefore, No employee, broker or agent of Aludra Estates will send you any electronic communications containing instructions to transfer funds to the employee, broker or sales agent’s personal bank account or provide non-public personal information, such as credit or debit card or bank account numbers.

You should not send non-public personal information, such as credit, debit card or bank account numbers, via phone calls, email or other unsecured electronic communications. It is common for fraudulent emails to be sent to solicit bank transfers, as these messages may appear to come from a trusted source.

If you receive any electronic correspondence directing you to transfer money or provide non-public personal information, even if this electronic correspondence appears to be from an employee, broker, or agent working for Aludra Estates, do not respond to it and immediately contact the management of Aludra Estates by phone or By email.

Do not use the contact information displayed in the message you receive. Such requests, even if they appear to be from an employee of Aludra Estates or someone else associated with Aludra Estates, are likely part of a scheme to defraud you by stealing money from you or using your identity to commit a crime. Aludra Estates L.L.C is committed to real estate laws Aldora circulars and directives issued by the Land Department that stipulate not to receive any cash or non-cash amounts from the client on behalf of the real estate developer. Aludra Estates L.L.C is also committed to the financial laws in theUnited Arab Emirates, which require it not to receive any commissions in cash, as Aludra Estates L.L.C confirms that it receives its commissions by check or bank transfer. Aludra Estates also confirms to its clients that it applies the procedures described below before undertaking any business with any client regarding the sale, purchase and rental of real estate units:

  1. TheFinancial Crimes Department communicates with the customer through an official email to implement the Know Your Customer standards, or what is known as the KYC standards imposed by the regulatory authorities in the United ArabEmirates.
  2. Signing a real estate brokerage agreement between the client and Aludra Estates Brokerage L.L.C called Form B, issued and officially registered by the LandDepartment.
  3. Aludra Estates L.L.C does not receive any cash from customers. Aludra EstatesBrokerage L.L.C is committed to receiving its commissions only from the real estate developer or the owner in the event that Aludra Estates sells or rents a residential or commercial real estate unit.
  4. In return, the sales department at Aludra Estates sends an official invoice and/or cash receipt for the amount received from the client. The official invoice must be stamped with the seal of Aludra Estates and signed with the signature of the sales manager of Aludra Estates or/and the General Manager of Aludra Estates.

Disclaimer of legal liability

Based on what was explained above in the policy of The user's responsibility towards attempts to defraud him of, Aludra Estates confirms that any client or visitor(real person or legal person) who communicates or wishes to communicate with the management of Aludra Estates or with one of the employees of Aludra Estates declares that (i.e. the client, whether a real or legal person) has read, agreed and accepted all the terms, conditions, policies and procedures described on the official website of Aludra Estates, as well as the internal terms, conditions, policies and procedures described and mentioned in the departments of Aludra Estates.

Aludra Estates also confirms that any client or visitor (real person or legal person)to the official website of Aludra Estates has agreed and accepted any amendments to the terms, conditions, policies and procedures described and mentioned on the official website of Aludra Estates, as well as any amendments.To the internal terms, conditions, policies and procedures described and mentioned in the departments of Aludra Estates, whether these modifications are minor or fundamental, and without Aludra Estates returning to request direct or indirect permission from any client or visitor (real person or legal person)who has visited Aludra Estates site or has completed or begun to complete any commercial dealings with Aludra Estates through its official website or through one of its employees inside or outside the offices of Aludra Estates.

Therefore, Aludra Estates completely disclaims responsibility for any commercial dealings that take place or have taken place between any client or visitor (real person or legal person) and its employees outside the framework of the official terms, conditions, policies and procedures for the commercial operations of Aludra Estates described and mentioned on the official website. Aludra Estates, as well as the terms and conditions, internal policies and procedures described and mentioned in the departments of Aludra Estates, specifically anti-fraud detection policies and procedures.

GOVERNING LAW AND JURISDICTION

Aludra Estates Terms & Conditions shall be governed and construed in accordance with the laws of United Arab Emirates – Dubai City.
